AGÎÞëÊÓƵ™s office files charges against Shell Pipeline

The Pennsylvania attorney general’s office filed 13 misdemeanor charges against Shell Pipeline Co. related to a 45-mile stretch of pipeline in Western Pennsylvania.

The charges filed Friday allege multiple violations of the state’s Clean Streams Law, according to a press release from the attorney general’s office. The violations are said to have occurred during the construction of the Shell Falcon Pipeline. The 97-mile pipeline extends from Houston to Potter Township in Beaver County before moving into Ohio. Work on the pipeline was completed in 2020.

According to the attorney general’s office, Shell did not notify the Department of Environmental Protection (DEP) about issues encountered during construction.

Charging documents explain that while drilling during construction, drilling mud is used to lubricate the drill bit. However, the mud can travel through fractures in the rock, and potentially resurface in wetlands or surface water.

Shell is accused of not disclosing all of its losses of drilling mud. It also is charged for not installing real-time data logging devices on equipment as required by Shell’s permit.

In an emailed statement, the company said it is, “reviewing the complaint and has been in contact with the (attorney general’s) office.”

“From the beginning of the construction of the Falcon Pipeline project, (Shell Pipeline Company) has cooperated with all relevant local, state and federal agencies and affected communities to ensure the pipeline was constructed in a safe, environmentally responsible manner,” the statement reads. “(Shell Pipeline Company) remains committed to protecting people and the environment, and to being a responsible neighbor in the communities where we live and work.”

A preliminary hearing is scheduled for 11 a.m. May 30 at the office of Magisterial District Judge Louis McQuillan.
